1. General
These Regulations define the general conditions, the manner of providing electronic services and sales via the Online Store www.bff.bio.The online store available at www.bff.bio is run by BEYOND FUNCTIONAL FOOD SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, at ul. Józefa Mehoffera 29 U2, 03-131, registered by
District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, KRS 000101547, NIP 5242961467, REGON 524280330, with a share capital of PLN 20,000.00, hereinafter referred to as the Seller.

1.1. Definitions
The terms used in these regulations mean:
- Customer -

- a natural person with full legal capacity, and in cases provided for by generally applicable regulations, also a natural person with limited legal capacity; legal person; an organizational unit without legal personality, which the law grants legal capacity; which has concluded or intends to conclude a Sales Agreement with the Seller.
- Civil Code - the Civil Code Act of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended).
- Account - the Customer's account in the Store, marked with an individual name (login) and password provided by the Customer; it collects data provided by the Customer and information about Orders placed by him in the Store.
- Shop - an online store run by the Seller on the Shopify platform at www.bff.bio.
- Product -

- a movable item available in the Store, which is the subject of the Sales Agreement between the Customer and the Seller.
- Regulations - these Store regulations.
- Sales contract - a Product sales contract concluded or concluded between the Customer and the Seller via the Store.
- Act on consumer rights - Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended)
- Order - Customer's declaration of intent addressed to the Store, aiming directly at concluding a Sales Agreement with the Seller
1.2. General information
- The Seller, to the fullest extent permitted by law, is not responsible for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
- Browsing through the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment does not require the creation of an Account in accordance with the provisions of §2 of the Regulations.
- Prices given in the Store are given in Polish zlotys and are gross prices (including VAT). The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including charges for transport, delivery and postal services), about which the Customer is informed on the Store's website when placing the Order, including at the time of expressing the will to be bound by the Sales Agreement.
- When the nature of the subject of the Agreement does not allow, judiciously judging, to calculate the amount of the final (final) price in advance, information on the manner in which the price will be calculated, as well as charges for transport, delivery, postal services and other costs, will be given in the Store in the Product description.
- To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:
- terminal device with access to the Internet and a web browser such as Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari;
- active e-mail account;
- cookies enabled;
- FlashPlayer installed.
2. Orders
2.1. Placing Orders
Orders can be placed via the website www.bff.bio. By placing an Order, the Customer concludes a Sales Agreement with the Seller under the conditions specified in the order and these regulations.
In order to place an Order, select the Product that is the subject of the Order, and then click the "Add to Cart" button, confirm the Order in the Basket and select one of the available payment methods and depending on the payment method.
2.2. Order Confirmation
After placing the Order, the Customer receives an automatic confirmation of its acceptance and the order number. This confirmation does not yet constitute acceptance of the order.
2.3. Order Acceptance
The order is accepted and the sales contract is concluded at:
- confirmation of the order by the Store to the Customer's e-mail address or by phone;
- sending products by the Store to the Customer's address provided in the Order form or Customer Account.
2.4. Product Availability
The store makes every effort to ensure that the products presented on the website are up-to-date and available in stock. In the absence of goods in stock, the Store will contact the Customer in order to present the available options, such as waiting for the delivery of the goods or canceling the order. The store is not liable for any damages resulting from unavailability of products.
3. Delivery and Payment Methods
3.1. Delivery methods
Delivery costs are covered by the Customer, unless otherwise agreed at the time of placing the order.
The Customer may use the following methods of delivery of the ordered Product:
- Courier Delivery
- Shipment to InPost Parcel Locker
- Personal collection at the Seller's stationary store
3.2. Payment Methods
The shop allows you to pay for the order using:
- Card payments
- Payment by bank transfer to the Seller's account
- Payment on delivery (in case of personal collection)
- Electronic payment via an external service operated by Przelewy24 and PayPal
4. Right to withdraw from the contract
- The buyer has the right to withdraw from the contract in writing without giving a reason within fourteen days from the date of conclusion of the contract under the Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended). In the event of a written withdrawal from the contract, the Customer is obliged to return the goods within fourteen days. The right referred to above also applies to a natural person concluding a contract directly related to his business activity, when the content of this contract shows that it is not of a professional nature for that person, resulting in particular from the subject of his business activity, made available on the basis of provisions on the Central Registration and Information on Economic Activity.
- The buyer described in point 1 of this paragraph may withdraw from the Sales Agreement by submitting a declaration of withdrawal from the Sales Agreement to the Seller.
- The statement of withdrawal from the Sales Agreement should be sent in writing or via e-mail to the addresses provided on the website www.bff.bio
- If the Buyer sends a statement described in point 1 of this paragraph, the Seller shall immediately send the Buyer to the e-mail address provided by him a confirmation of receipt of the declaration of withdrawal from the Agreement.
- Consequences of withdrawing from the Sales Agreement:
- In the event of withdrawal from the Agreement concluded remotely, the Agreement is considered void.
- In the event of withdrawal from the Agreement, the Seller returns to the Buyer described in point 1 of this paragraph immediately, not later than within 14 days from the date of receipt of the Buyer's declaration of withdrawal from the Agreement, all payments made by him, including the costs of delivering the Products, with the exception of additional costs resulting from the method of delivery chosen by the Buyer other than the cheapest usual method delivery offered by the Seller.
- The Seller will return the payment using the same payment methods that were used by the Buyer in the original transaction, unless the Buyer has expressly agreed to a different solution that will not involve any costs for him.
- The Seller may withhold the reimbursement until receipt of the Products back or until proof of their return is provided, whichever occurs first.
- The Buyer should send the Products to Beyond Functional Food, ul. Klecińska 123 lok. 2.10 bud. ALFA, 54-413 Wrocław, immediately, no later than 14 days from the date on which he informed the Seller about withdrawal from the Agreement. The deadline will be met if the Buyer sends back the Product before the expiry of the 14-day period.
- The Buyer bears the direct cost of returning the Product if, due to its nature, the Product could not be returned by regular mail.
- The Buyer is responsible for reducing the value of the Product resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the Product.
- The Seller accepts returns only of Products that do not bear signs of use.
- The right to withdraw from the Agreement by the Consumer is excluded in the case of:
- A contract in which the subject of the service is goods that deteriorate quickly or have a short shelf life;
- A contract in which the subject of the service is goods delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.
5. Complaints
- The Sales Agreement covers new Products.
- In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions on warranty in the Civil Code. The right referred to above also applies to a natural person concluding a contract directly related to his business activity, when the content of this contract shows that it is not of a professional nature for that person, resulting in particular from the subject of his business activity, made available on the basis of provisions on the Central Registration and Information on Economic Activity.
- A complaint should be submitted in writing or electronically to the Seller's addresses available on the Store's website
- Goods returned under the complaint procedure should be sent to the address Beyond Functional Food, ul. Klecińska 123 lok. 2.10 bud. ALFA, 54-413 Wrocław. The Seller will respond to the complaint request immediately, and if the Customer is a Consumer - no later than within 14 days. If the Customer is a Consumer and the Seller does not respond to the complaint request within 14 days, it is considered that the Customer's request was justified.
- This complaint policy applies to purchases made in the Store within the meaning of the www.bff.bio website and does not apply to purchases made in stationary stores or other online stores.
- The complaint policy may change at any time. Any changes will be published on the website at www.bff.bio.
6. Out-of-court methods of settling complaints and pursuing claims
The Customer who is a Consumer has e.g. the following possibilities of using out-of-court methods of dealing with complaints and pursuing claims:
- is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection with a request to settle a dispute arising from the concluded Sales Agreement;
- is entitled to apply to the voivodship inspector of the Trade Inspection with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Customer and the Seller;
- may obtain free assistance in resolving the dispute between the Customer and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers) . Advice is provided by the Consumer Federation at the toll-free consumer helpline number 800 007 707 and by the Polish Consumers Association at the email address: advice@dlakonsumentow.pl;
- submit your complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/.
7. Personal data
- The administrator of Customers' personal data collected via the Store is the Seller.
- Customers' personal data collected by the administrator via the Store are collected in order to implement the Sales Agreement, and if the Customer agrees - also for marketing purposes.
- Recipients of personal data of the Online Store Customers may be:
- In the case of a Customer who uses the Online Store with the method of delivery by post or courier, the Administrator provides the Customer's collected personal data to the selected carrier or intermediary performing the shipment at the request of the Administrator.
- In the case of a Customer who uses the Online Store with the method of electronic payments or a payment card, the Administrator provides the Customer's collected personal data to the selected entity servicing the above payments in the Online Store.
- The customer has the right to access and correct their data.
- Providing personal data is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude the Sales Agreement results in the inability to conclude this contract.
8. Final Provisions
- The Seller reserves the right to amend the Regulations for important reasons, that is: changes in the law, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer of any change at least 7 days in advance.
- In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the act on the provision of electronic services; the Act on Consumer Rights, the Act on the Protection of Personal Data, as well as European Union law, in particular the GDPR (Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC)
