1.1. Definitions
The terms used in these regulations mean:
- Customer - a natural or legal person purchasing Products.
- Store - the online store operated by the Seller at www.bff.bio.
- Consumer - a natural person making a purchase for purposes unrelated to their business, trade or profession, within the meaning of the Polish Consumer Rights Act.
- Product - a movable item offered through the Store.
- Order - a declaration of intent submitted by the Customer through the Store with the purpose of entering into a Sales Agreement.
- Terms and Conditions - this document.
- Sales Agreement - a distance agreement concluded electronically through the Store between the Customer and the Seller.
1.2. General information
To use the Store, including browsing its assortment and placing Orders, the Customer must have a device with Internet access and a web browser, an active email account and cookies enabled.
To the fullest extent permitted by law, the Seller shall not be liable for any disruption, including interruptions in the operation of the Store, caused by force majeure, unlawful actions of third parties or incompatibility between the Store and the Customer’s technical infrastructure.
2. Orders
Orders may be placed through the website at www.bff.bio.
Placing Orders for Products available in the Store does not require the Customer to create an account and may be completed as a guest.
To place an Order, the Customer must select a Product, click “Add to Cart”, confirm the Order in the shopping cart, select one of the available payment methods and follow the instructions displayed on the website.
The Order summary shows all applicable costs, including the price of the Product and delivery costs, including transport, delivery and postal charges.
Where the nature of the subject matter of the agreement does not reasonably allow the final price to be calculated in advance, information on how the price will be calculated, together with any transport, delivery, postal and other applicable charges, will be provided in the Product description.
After placing an Order, the Customer will receive an automatic confirmation that the Order has been received, together with the Order number. This confirmation does not yet constitute acceptance of the Order.
The Store may allow the Customer to access information concerning previous Orders following verification of the Customer’s email address. This functionality is provided free of charge and is not required in order to place an Order.
The Order is accepted and the Sales Agreement is concluded when the Customer receives confirmation from the Store that the Order has been accepted for processing or when the Products are dispatched to the Customer’s address provided in the Order form or through the Customer’s account.
Upon the Seller’s acceptance of the Order or dispatch of the Product, the Customer enters into a Sales Agreement with the Seller on the terms specified in the Order and these Terms and Conditions.
The Store makes every effort to ensure that the Products displayed on the website are up to date and available in stock. If a Product is unavailable, the Store will contact the Customer to present the available options, such as waiting for the Product to be restocked or cancelling the Order.
3. Delivery and Payment Methods
Delivery costs shall be borne by the Customer unless otherwise agreed when the Order is placed. The Customer may select one of the delivery methods available for the relevant Order.
The Store allows electronic payments to be made through third-party payment services available on the Order page.
Product prices are displayed in the currency applicable to the country or market selected by the Customer and include all applicable taxes.
4. Right to withdraw from the contract
Any Customer who is a Consumer has the right to withdraw from a distance Sales Agreement without giving any reason within 14 days from the date on which the Consumer received the ordered Product. The Consumer may use the withdrawal form provided in Appendix 1 to these Terms and Conditions, although using this form is not mandatory.
To exercise the right of withdrawal, the Consumer must inform the Seller of their decision using:
- the withdrawal link available at the bottom of each page of the Store;
- the contact form available on the Store’s contact page;
- the automated Order editing and returns functionality available after logging in to the Customer’s account.
Upon receipt of the withdrawal notice, the Seller will promptly send confirmation of its receipt to the email address provided by the Customer.
If the Consumer withdraws from the Sales Agreement, the Seller will reimburse all payments received from the Consumer, including the cost of delivering the Product, except for any additional costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard delivery method offered by the Store.
The reimbursement will be made no later than 14 days from the date on which the Seller receives the Consumer’s notice of withdrawal. The Seller will use the same payment method that the Consumer used for the original purchase unless the Consumer expressly agrees to another method.
The Customer shall bear the cost of returning the Product to the Store. This means that if the Customer decides to withdraw from the Sales Agreement, the Customer must return the Product at their own expense to:
Beyond Functional Food
ul. Duńska 11/SIGMA 1.06
54-427 Wrocław
Poland
The Product must be returned no later than 14 days from the date on which the Customer informed the Seller of the decision to withdraw from the Sales Agreement. The deadline will be met if the Customer dispatches the Product before the expiry of the 14-day period.
The Store may withhold reimbursement until it has received the returned Product or until the Customer provides proof that the Product has been dispatched, whichever occurs first.
The returned Product should be undamaged, clean, in its original packaging and should not show signs of use beyond what is necessary to examine the Product. The Customer shall be liable for any reduction in the value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functionality.
The right of withdrawal does not apply to:
- Products that are liable to deteriorate or expire rapidly;
- Products with a short shelf life;
- Products supplied in sealed packaging that cannot be returned after opening for health protection or hygiene reasons, where the packaging has been opened after delivery.
5. Complaints Concerning Products Not in Conformity with the Sales Agreement
The Seller is required to deliver Products that conform to the Sales Agreement and shall be liable to the Consumer for any lack of conformity in accordance with the Polish Consumer Rights Act.
A complaint may be submitted electronically using the contact form or in writing to:
Beyond Functional Food
ul. Duńska 11/SIGMA 1.06
54-427 Wrocław
Poland
The Customer is advised to provide the Order number, a description of the lack of conformity and details of the remedy requested. Failure to provide this information does not affect the validity of the complaint.
If a Product does not conform to the Sales Agreement, the Customer may request that the Product be repaired or replaced. If repair or replacement is impossible or ineffective, or if the lack of conformity is material, the Customer may request a price reduction or withdraw from the Sales Agreement.
The Customer may not withdraw from the Sales Agreement if the lack of conformity is immaterial.
The Seller shall be liable for any lack of conformity that existed at the time the Product was delivered and became apparent within two years of that date, unless the Product’s use-by date is longer.
The natural expiry of the Product’s shelf life, storage or use of the Product contrary to its intended purpose, or the Customer’s subjective impressions concerning, for example, its scent, consistency or colour, shall not constitute a lack of conformity unless they result from a defect in the Product.
The Seller will respond to the complaint within 14 days of receiving it. If the Seller fails to respond within this period, the complaint will be deemed accepted.
If the complaint is accepted, the Seller will reimburse the reasonable costs of returning the Product and cover the cost of delivering a new or repaired Product.
The provisions above shall apply accordingly to a natural person entering into an agreement directly related to their business activity where the agreement is not of a professional nature for that person.
6. Out-of-Court Dispute Resolution
A Customer who is a Consumer may use out-of-court complaint and redress procedures.
In particular, the Consumer may:
- apply to a permanent consumer arbitration court operating at the Trade Inspection Authority;
- request that the relevant Provincial Inspector of the Trade Inspection Authority initiate mediation proceedings;
- obtain free assistance from a municipal or district consumer ombudsman or a consumer organisation.
7. Personal Data
The Seller is the controller of the Customers’ personal data.
Personal data is collected for the purpose of performing Sales Agreements and, where the Customer has given the relevant consent, for marketing purposes.
Detailed information concerning the processing of personal data and the Customer’s rights is provided in the Privacy Policy available on the Store’s website.
8. Final Provisions
The Seller reserves the right to amend these Terms and Conditions for valid reasons, including changes in applicable law, payment or delivery methods, or the functionality of the Store.
The amended Terms and Conditions will be published on the Store’s website and will apply to Orders placed after the date of their publication.
Orders placed before the amendments take effect will be governed by the version of the Terms and Conditions applicable at the time the Order was placed.
Before placing each Order through the Store, the Customer must expressly accept the current version of these Terms and Conditions by selecting the relevant checkbox in the Order form. An Order cannot be placed without accepting the Terms and Conditions.
Any matters not regulated by these Terms and Conditions shall be governed by Polish law, in particular the Polish Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act, the Personal Data Protection Act and Regulation (EU) 2016/679 (GDPR).
